Dorgan to introduce supplement funding amendment prohibiting offshore contractors

A top Senate Democrat wants government contractors to stop dodging U.S. tax laws by setting up offshore firms in known tax havens.

Sen. Byron Dorgan, D-N.D., said May 7 he will offer an amendment to the fiscal 2008 emergency Defense Department supplemental to restrict any of the supplemental funds from going to firms that set up offshore subsidiaries to avoid paying U.S. taxes.

Houston-based KBR, which holds a multibillion-dollar Army logistics contract, lists its 10,500 employees working in Iraq as employees of two Cayman Island firms that don’t have phone numbers or offices, Dorgan’s statement said. Another logistics and construction firm, IAP Worldwide Services, hires Americans through offshore subsidiaries to avoid paying Social Security taxes, according to the statement. More

Senate Democrats Seeking a Special Tax on Oil Profits

WASHINGTON (AP) — Senate Democrats on Wednesday called for a temporary special tax on oil companies’ profits and a rollback of $17 billion in oil industry tax breaks as part of an energy package. The Democrats are also seeking federal penalties on energy price gouging and a suspension of oil deliveries into the government’s emergency reserve.

Senate Republicans strongly oppose any additional oil industry taxes, which are widely viewed as unlikely to be enacted and would almost certainly prompt a veto by President Bush.

The proposed 25 percent profits tax would apply just to oil company earnings above what would be considered “reasonable” and only if those profits are not reinvested in expanding refinery capacity or renewable energy sources, according to a summary of the proposals.

The tax would expire after two years.

The only section of the Democrats’ proposal that seems to have widespread bipartisan support is suspending deliveries into the government’s Strategic Petroleum Reserve until oil prices drop to $75 a barrel. More

Rush Limbaugh Calling For Riots In Denver

DENVER — Talk show host Rush Limbaugh is sparking controversy again after he made comments calling for riots in Denver during the Democratic National Convention this summer.

He said the riots would ensure a Democrat is not elected as president, and his listeners have a responsibility to make sure it happens.

“Riots in Denver, the Democrat Convention would see to it that we don’t elect Democrats,” Limbaugh said during Wednesday’s radio broadcast. He then went on to say that’s the best thing that could happen to the country.

“Secure Election Act” Coming Up For Vote

 ”The US House of Representatives is considering HR. 5036, the ‘Emergency Assistance for Secure Elections Act of 2008,’ as introduced by Representative Rush Holt. The bill is scheduled for a floor vote later today. It would provide for emergency paper ballots, money for the addition of voter verifiable paper ballots to existing systems, and post-election audits. Crucially, the change to paper is opt-in, making it possible for local jurisdictions to govern their own choices. Here are two summaries of the bill. It was reported out of committee with strong bipartisan support. As of this morning the White house has opposed the bill but not threatened a veto, and some previously supportive Republicans have now changed their tune. Siegelman on 60 Minutes: Karl Rove has Succeeded in Ruining Political Career

 ”Politics for me…in terms of electoral politics–is over,” says former Alabama governor Don Siegelman, once considered the most successful Democrat in his state, to CBS’ 60 Minutes. “I think that’s what Karl Rove wanted; he has accomplished his goal.”

 

“Frankly,” he continues, “I’m about busted financially. I’ve spent my life savings…I’ve spent a lot of money on trying to muster my defense.”

 

Governor Siegelman, as RAW STORY has extensively reported in thePermanent Republican Majority series, was prosecuted and imprisoned with the help of US Attorneys, federal prosecutors and judges said to have been hand-picked operatives under the watch of former Bush advisor Karl Rove.

 

Siegelman has been released on appeal.

Will Rush Limbaugh Be Indicted for Voter Fraud?

As the board of election in Cuyahoga County, Ohio, where Cleveland is located, launches an investigation into illegal crossover voting in the state’s 2008 presidential primary, a big open question remains unanswered: Will county officials go after the ringleaders of apparently illegal electioneering where thousands of Republican voters swore — under penalty of law — allegiance to the Democratic Party in order to vote for Hillary Clinton?

In case you missed it, Rush Limbaugh, the nation’s top-rated talk radio host, was urging Republicans in Texas and Ohio to skip their party’s primary on March 4 and instead cast a vote for Hillary Clinton in order to prolong the fight between her and Barack Obama. And that Tuesday, as media in both states reported, thousands of Republicans did just what Limbaugh and others had suggested — they changed parties to vote for Clinton.

“I want Hillary to stay in this, Laura,” Limbaugh told Laura Ingraham on Feb. 29, near the start of his Hillary crusade. “This is too good a soap opera. We need Barack Obama bloodied up politically, and it’s obvious that the Republicans are not going to do it and don’t have the stomach for it, as you probably know.”And on Wednesday, the day after the Ohio primary, Fox News asked Clinton if she owed Limbaugh a thank you. “Be careful what you wish for, Rush,” she replied. Later that day, Limbaugh played the Fox tape on his show and said, “How do you interpret this, folks? She could have said thank you. She could have said thank you! In fact, I was expecting in her victory speech last night to be thanked.”I helped give Mrs. Clinton the biggest and happiest moment and night of the campaign season so far, maybe her life, and she tells me, “Be careful what you wish for, Rush”? Why, that sounds like a threat, does it not? I’ve got a Democrat presidential candidate threatening your host. Why, I am stunned! After all I did …”

While this all makes for great talk radio and sounds like fun, there is one catch: What Limbaugh encouraged Republican voters to do in Ohio was a fifth-degree felony in that state, punishable with a $2,500 fine and six to 12 months in jail. That is because in order to change party affiliation in Ohio, voters have to fill out a form swearing allegiance to that party’s principles “under penalty of election falsification.”

On Thursday, March 20, the Cleveland Plain Dealerreported that the “Cuyahoga County Board of Election has launched an investigation that could lead to criminal charges against voters who maliciously switched parties for the March 4 presidential primary.” According to the report, “One voter scribbled the following addendum to his pledge as a new Democrat: “For one day only.”

“Such an admission amounts to voter fraud,” the report continued, attributing that conclusion to BOE member Sandy McNair, a Democrat. The report said the four-member board — two Democrats and two Republicans — had yet to vote on whether it would issue subpoenas, although Ohio’s secretary of state, Democrat Jennifer Brunner, is empowered to cast tie-breaking votes when the BOE is deadlocked.

Ohio Investigating Possible Vote Machine Tampering Last Year

 ”The Columbus Dispatch is reporting on a criminal investigation currently being performed in Franklin County Ohio. It seems several voting machines listed a candidate as withdrawn from the race when in fact he wasn’t. By the time the investigations tracked down which machines had been affected, the candidate’s name was back on the ballot. Normally, we could dismiss this as confusion or a mistake on the part of the voter(s) who noticed it. In this case, the person who first noticed the discrepancy was Ohio Secretary of state Jennifer Brunner. Further compounding matters, the Franklin County Board of Elections had disabled virtually all logging on the machines to speed setup of the balot. Naturally, the county board remains sceptical of these accusations.”

Signs of life from House Democratic leaders

 Fully recognizing it may not last any longer than a couple of weeks, it’s actually necessary to give some credit where it’s due — to the House Democratic leadership. Nobody expected that they would ever allow the Protect America Act to expire, yet they did. And nobody expected, especially after the meek and incoherent appearance of Silvestre Reyes on CNN last weekend, that they would ignore the barrage of Terrorist-Lover accusations from the President and unveil yet another bill that is actually decent and refuses to bestow lawbreaking telecoms with amnesty, but they now have.

Add to that the fact that they actually seem serious about pursuing a court battle to force Josh Bolton and Harriet Miers to comply with their Subpoenas, and one detects a possible change in their approach. There is perhaps a stirring of recognition among House Democrats that there is no political cost to standing against this President on vital matters — even ones involving the magic Terrorism word — and there might even be real political benefit.With regard to yesterday’s FISA bill, more surprising than their defiance is their shrewdness. By including a provision that explicitly authorizes telecoms to submit to the court any exculpatory documents — notwithstanding the assertion by the administration that those documents are subject to the “state secrets” privilege — the House bill completely guts, in one fell swoop, the primary argument that, for months, has been made by telecoms and their allies as to why amnesty is necessary.As Marcy Wheeler documented several months ago, the primary — really the sole — excuse given by the Senate Intelligence Committee as to why telecom amnesty was necessary was that the telecoms did nothing wrong but were being blocked by the administration from using the documents they have to prove it. From the Committee’s report recommending telecom amnesty:

To the extent that any existing immunity provisions are applicable, however, providers have not been able to benefit from the provisions in the civil cases that are currently pending. Because the Government has claimed the state secrets privilege over the question of whether any particular provider furnished assistance to the Government, an electronic communication service provider who cooperated with the Government pursuant to a valid court order or certification cannot prove it is entitled to immunity under section 2511(2)(a)(ii) without disclosing the information deemed privileged by the Executive branch.

It’s critical to emphasize — as that passage references — that thetelecoms already have immunity under existing statutes, even if they broke the law, as long as they obtained from the Attorney General certifications that the warrantless surveillance requests were legal. If the telecoms really did obtain those certifications — and it’s extremely unlikely that they did — then all they ever had to do was just show them to the court and they would be immune. Their excuse up until now — “we can’t use the documents we have to defend ourselves because we aren’t allowed to show them to the judge” — is now completely eliminated by the House bill.
